SERVICE AGREEMENT

PROVIDER IDENTIFICATION

The services subject to this service agreement are provided by PINEAPP S.r.l., with registered office in Imola, via Callegherie n. 27 and operational office in Imola, via Appia n. 31, registered with the Chamber of Commerce of Bologna under number REA BO-553165, tax code and VAT number 03880931203, hereinafter referred to as the "Provider".

1. OBJECT OF THE CONTRACT

1.1 This contract regulates the user's purchase of a paid subscription plan for the use of the digital services provided by the Cinzia application.

2. ACCESS, PURCHASE, AND PAYMENT FOR SERVICES

2.1 The user who has downloaded the application and created their personal account can use the Cinzia chat for free or select one of the paid subscription plans - Base, Plus, or Professional. Each user can create and use only one free account.2.2 In order to purchase a subscription to one of the proposed paid plans, the user must conclude the digital service purchase contract. The contract between PINEAPP S.r.l. and the user is concluded exclusively through the internet, where, following the indicated procedures, the user will finalize the "online sales contract".2.3 The online sales contract is concluded by consenting to the purchase expressed through the online application, always after viewing a web page summarizing the purchased service, the cost of the service, and any additional charges of the methods of withdrawal.
2.4 Once the Provider receives the user's consent to purchase, it creates a confirmation web page summarizing the order, which can always be viewed through the Platform and includes the information referred to in the previous point.
2.5 The contract is not considered perfected and effective between the parties unless the above point is followed.
2.6 The cost of the different subscription plans is monthly and is specified in the application on the purchase page and includes any applicable taxes and fees. The cost of the different subscription plans may change over time, but changes will not affect requests already made by the user.
2.7 The procedure for purchasing subscription plans ends with payment, which can be made through:

2.8 All communications related to payments are done through Secure Sockets Layer (SSL) technology to protect the security of your credit card data.
2.9 Credit card data forwarded on websites and applications is saved and processed by Stripe, which has agreed by contract to comply with all rules, standard regulations or guidelines adopted or requested by credit card payment brands (including, without limitation, Visa, MasterCard, American Express, Discover, and JCB) or the Payment Card Industry Security Standards Council in relation to privacy, data security, as well as safeguarding, disclosure, and management of payment instrument data, including, without limitation, Payment Card Industry Data Security Standards, Cardholder Information Security Program Visa, Information Security & Compliance Program Discover, Data Security Operating Policy American Express, Site Data Protection Program MasterCard, Payment Application Best Practices. Payment Application Best Practices Visa, Payment Card Industry’s Payment Application Data Security Standard, POS Terminal Security program MasterCard and the Payment Card Industry PIN Transmission Security program, in any case, regularly modified.
2.10 The purchase of a subscription plan by the user will allow the provider to charge the user's credit card for the first payment and future monthly payments until the end of the contract.
2.11 With the purchase of a subscription plan, the user consents to the execution of the contract that allows the user to access Cinzia to take place immediately, before the conclusion of the withdrawal period referred to in article 4.
2.12 The subscription plan purchase contract is considered indefinite, subject to the user's right of withdrawal as regulated in article 4.

3. SERVICE PROVISION

3.1 The chatbot service will be automatically provided through the application and will be immediately active in the "free entry" mode or in one of the selected subscription plans following the conclusion of the purchase contract.

4. RIGHT OF WITHDRAWAL

4.1 The user has the right to withdraw from the contract, without giving any reason, within 14 days from the day of the conclusion of the contract.
4.2 In the event that the right of withdrawal is exercised within 14 days from the conclusion of the contract, the cost of the subscription will be refunded to the user without undue delay and, in any case, no later than 14 days from the day PINEAPP S.r.l. was informed of the user's decision to withdraw from this contract. The refund will be made using the same means of payment used for the initial transaction; the user will not incur any costs as a result of the refund.
The user has the right to withdraw from the contract, without giving any reason, at any time after the 14 days from the day of the conclusion of the contract.
4.4 In the event that the right of withdrawal is exercised under article 4.3, that is, after 14 days from the conclusion of the contract, the user will not be entitled to a refund of the subscription cost paid for the current month.
4.5 In case the user decides to exercise the right of withdrawal provided for in points 4.1 and 4.3, they must communicate it explicitly to PINEAPP S.r.l. by e-mail at the address cinzia@pineappsrl.com. To comply with the withdrawal period referred to in article 4.1, it is sufficient for the user to send the communication regarding the exercise of the withdrawal before the expiration of the 14 days from the conclusion of the contract.
4.5 To exercise the right of withdrawal, the user can use the attached form (Withdrawal Form) by sending it via email to cinzia@pineappsrl.com. 4.6 Upon receiving the communication with which the user communicates the exercise of the right of withdrawal, the parties to this contract are released from their respective obligations.

5. TERMINATION

5.1 PINEAPP S.r.l. may terminate this contract if the user violates the Terms of Use of Cinzia, which they accepted at the time of first registration and are available here.
5.2 PINEAPP S.r.l. may also terminate this contract if it is impossible to collect the monthly subscription amount.5.3 PINEAPP S.r.l. will send the communication of termination of this contract for the reasons referred to in articles 5.1 and 5.2 by e-mail to the address provided by the user at the time of first access.

6. INVOICING

6.1 The application automatically generates a tax document between PINEAPP S.r.l. and the user, with the subject being the service provided through the application.

7. PARTIAL NULLITY

7.1 In the event that a clause or part of the Service Contract is deemed null, illegal or illegitimate, it will not affect the rest of the contract and its validity and effectiveness.

8. JURISDICTION AND APPLICABLE LAW

8.1 The relationship between PINEAPP S.r.l. and the users are governed by the law of the State where the user resides.
For any dispute concerning this contract, given the user's consumer nature, the provisions of Legislative Decree no. 206/2005 will apply, and the competent court will be the one indicated as the user's residence or domicile.
8.2 For the out-of-court resolution of disputes arising in relation to this contract, the user may use the mediation procedure provided for by Legislative Decree no. 28/2010 or may use ADR bodies through the ODR online dispute resolution platform established and managed by the European Commission, accessible through the following link http://ec.europa.eu/consumers/odr/. For any information on how to use the ODR platform, the user may contact the Supplier at the following email address: cinzia@pineappsrl.com.
